Alright. According to The Telegraph:
The 41 year-old had been in a relationship with a man whom he lived with and told officials â€śit would make me feel happyâ€ť for it to continue. But his local council decided his â€śvigorous sex driveâ€ť was inappropriate and that with an IQ of 48 and a â€śmoderateâ€ť learning disability, he did not understand what he was doing…
The judge said it requires an understanding and awareness of the â€śmechanics of the actâ€ť, â€śthat there are health risks involvedâ€ť and that sex between a man and a woman may lead to pregnancy. He said that the psychiatrist thought Alan â€śbelieved that babies were delivered by a stork or found under a bushâ€ť, and that â€śsex could give you spots or measlesâ€ť.
On that basis the judge ruled that Alan did not have the capacity to consent to sex, but also ordered that the council should provide him with sex education â€śin the hope that he thereby gains that capacityâ€ť.
My problem isn’t that they asked him questions – though I think you can get a bit of a scary Big Brother vibe if the government is going to decide who is smart enough to have sexual relations. My problem is that they didn’t seem to take into account the fact that he answered the questionsÂ correctly.
If you ask someone “why do you want to keep having sex?” the wrong answer is “penguins.” The right answer is “because I want to,” or, as the man pretty aptly put it “because it will make me happy.” Okay, there are probably other factors to take into consideration (because I love the person, because I want to have a child, because I skipped the gym today) but we live in a secular enough society that the only answer necessary is “because I want to.”
Rock on, 48 IQ guy. You’re going into this with the right spirit. Really, a far better spirit than a lot ofÂ people with higher IQs. Â
As for the fact that he thinks it can cause spots? Well, it can. Those spots are called “herpes.” I don’t know about measles. Probably not. Do we know sex can’t cause measles? Maybe it can. It seems like something sex would go and do, wouldn’t it? Well, there’sÂ a new reason to be hermit. Â
He doesn’t know where babies come from? He has a gay lover. He’s gay. And I don’t think he’s going to embark on a lengthy adoption process.
So, really, yes. Yes, he should.
