New Mexico Republican Introduces Bill That Would Designate Post-Rape Abortions As ‘Tampering With Evidence’

A Republican lawmaker in New Mexico has introduced a bill into the state legislature that would make aborting the fetus of your rapist a third-degree felony. Bearing the misleadingly non-insane title of House Bill 206, it would prosecute anyone who knowingly aborts, or facilitates the abortion of, a pregnancy conceived via rape for “tampering with the evidence.”

More specifically:

“Tampering with evidence shall include procuring or facilitating an abortion, or compelling or coercing another to obtain an abortion, of a fetus that is the result of criminal sexual penetration or incest with the intent to destroy evidence of the crime.”

The state congresswoman (woman!) who introduced the bill, Cathrynn Brown, says it’s meant to keep perpetrators of rape and incest from covering up their crimes by making the victim have an abortion, but that’s obviously bullshit. After all, is there really any way to prove someone is aborting the fetus “with the intent to destroy evidence” versus the intent to get rid of an unwanted rape pregnancy? Shouldn’t forced or coerced abortion already fall under the umbrella of “abuse, etc.” that the person is being charged with?

This going without saying, but just because a crime has been perpetrated upon you doesn’t mean you are legally obligated to do anything. The victims of crimes aren’t even legally obligated to file a police report, so they should hardly be obligated to carry their rape babies to term. This law would turn rape victims into felons, re-victimizing them in a way too horrible to even think about. Even many of abortion’s opponents want to make exceptions for victims of rape and incest, despite that not being logically consistent with the position that abortion is unjustifiable murder. That’s how obviously horrible this situation is.

Pat David of ProgressNowNewMexico called the bill “blatantly unconstitutional,” saying:

“The bill turns victims of rape and incest into felons and forces them to become incubators of evidence for the state. According to Republican philosophy, victims who are ‘legitimately raped’ will now have to carry the fetus to term in order to prove their case.“

Luckily, the New Mexico state legislature has a majority of liberals and non-awful people, so the bill is not likely to pass. However, its legacy is bound to live on in “Wackadoo Attacks On Reproductive Rights” slideshows for years to come.

      I just threw up a little bit.

      The idea of that bill is absolutely HORRIFIC. I thought things couldn’t get any worse in this war against women but goodness, was I wrong. I am so glad that there are people with the common sense to vote against this. I will personally take it as a sign of the end of the world if something this monumentally stupid and blatantly sexist was allowed to happen.
